These Terms of Service ("Terms") govern your use of AIPhoto and its services available at aiphoto.io. By using AIPhoto, you agree to these Terms. If you do not agree, please do not use the service.

1. Service Description

AIPhoto provides an AI-powered image generation service that allows users to create images from text descriptions ("prompts") using third-party AI models. The service is provided "as is" and is subject to availability.

2. Eligibility

You must be at least 13 years of age to use AIPhoto. By using the service, you represent that you meet this requirement. If you are under 18, you must have parental consent.

3. Acceptable Use

You agree not to use AIPhoto to generate:

  • Content that is sexually explicit involving minors (CSAM). This is strictly prohibited and will be reported to relevant authorities.
  • Content that depicts real individuals in defamatory, harassing, or non-consensual ways.
  • Content that incites violence, hatred, or discrimination based on race, ethnicity, gender, religion, disability, or sexual orientation.
  • Content designed to deceive others about its AI-generated nature in harmful contexts (e.g., political disinformation).
  • Content that infringes on third-party intellectual property rights.

Violation of these rules may result in IP-level blocking and reporting to law enforcement where applicable.

4. Intellectual Property & Content Ownership

4.1 Your Generated Content

Images you generate using AIPhoto are yours. You retain full rights to use, modify, distribute, and commercialize them, subject to the terms of the underlying AI model providers (OpenAI, Black Forest Labs, Stability AI, etc.).

4.2 AIPhoto Intellectual Property

The AIPhoto platform, interface, code, brand, and design are the intellectual property of AIPhoto. You may not reproduce, modify, or distribute any portion of the platform without our express written permission.

5. Rate Limits & Fair Use

The Free plan is limited to 5 image generations per IP address per day. Attempts to circumvent this limit (e.g., using VPNs, proxy networks, or automated scripts to artificially inflate usage) are a violation of these Terms and may result in a permanent ban.

6. Disclaimer of Warranties

AIPhoto is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the accuracy, reliability, availability, or fitness for a particular purpose of the service. We do not guarantee that generated images will meet your expectations or be free from errors.

7. Limitation of Liability

To the maximum extent permitted by applicable law, AIPhoto and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the service, including but not limited to loss of profits, data, or goodwill.

8. Third-Party Services

AIPhoto routes requests through third-party AI APIs (OpenRouter, OpenAI, Black Forest Labs, Stability AI). We are not responsible for the availability, performance, or content policies of these third-party services. Their respective terms of service also apply to your use of their models through our platform.

9. Content Moderation

We rely on the content filtering systems of the underlying AI model providers. While we make reasonable efforts to prevent harmful content generation, we cannot guarantee that all generated content will comply with all applicable laws and regulations in every jurisdiction.

10. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of AIPhoto at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of AIPhoto shall be resolved through binding arbitration or in the courts of competent jurisdiction.

12. Changes to Terms

We may update these Terms periodically. The "Last updated" date reflects the most recent revision. Continued use of AIPhoto after changes constitutes acceptance of the revised Terms.
